Eminent domain is the right of a government to take private property for public use by virtue of the superior dominion of the sovereign power over all lands within its jurisdiction. Schulte said he received little or no response several weeks ago when the possibility of a municipal takeover first was mentioned, but council members appear to be more receptive now.

Since the idea was first proposed, the Rev. Edward Hoffmann of Presentation Church contacted Monsignor Charles Owen Rice of the Pittsburgh Diocese to commend him for an article he wrote on Crucible's plight for a Catholic publication. Rice discussed the possibility of a municipal takeover, among other topics, in his article. Schulte said invoking eminent domain could take a year or more, but the time might be well spent because it would tie the hands of Crucible's parent firm Colt Industries Inc. "so they couldn't sell anything piecemeal from the plant." New York-based Colt has refused to release any asking price or otherwise estimate the value of the plant since its March 10 sale notice.

At that time, Colt said it would dispose of the plant by year's end, either selling it or shutting it down. Pittsburgh-based Cyclops Corp. announced agreement in principle with Colt in June to purchase the plant, but only if it could get concessions from three United Steelworkers locals representing workers. A concessions agreement was reached but talks between Colt and Cyclops broke off. No new buyer emerged.

The historic proposed merger between Citicorp, the nation's second largest bank holding company, and the $3 billion Fidelity Savings and Loan would be the first across state and industry lines. The Fed's public hearing on the merger will take place Saturday, Sept.

4. Comments on the merger are being accepted through Sept. 2. Along with the merger comes the prospect of accelerating the shrinkage of the ailing thrift industry. California's bankers already are on record as vigorously opposing the incursion of Citicorp, the parent of Citibank, with $120 billion in assets.

The savings industry also considers the bank board's approval as "unfortunate" and "regrettable But analysts say the magnitude of Fidelity's problems, which caused California authorities to close it in April and transfer operations to federal authorities, made such a takeover by a giant financial institution inevitable.
