Pensacola area restaurant inspections: 2 restaurants receive administrative complaints (2024)

Here's the breakdown of recent restaurant inspections in Escambia and Santa Rosa counties for the week of May 27-June 2. Florida's restaurant owners are not required to post restaurant inspection results where guests can see them. So, every week, we provide that information for you.

During the latest round of inspections from the Department of Business and Professional Regulation two restaurants received an administrative complaint, three restaurants received a high priority violation, and 13 restaurants passed their first inspection with zero violations.

Two restaurants receive an administrative complaint

Follow-up inspection: Violations required further review but are not an immediate threat to the public. The restaurant complied with a follow-up inspection on May 31 and met inspection standards.

Total violations: One total violation, with one high-priority violation

Details of high priority violations:

  • High Priority - Live, small flying insects in kitchen, food preparation area, food storage area and/or bar area. Approximately 10 live, small flying insects in the following locations: approximately five above hand wash sink in back prep area, three around ware washing area, one in lobby, and one in front kitchen area. **Admin Complaint**

Inspection details: Routine Inspection on May 28

Follow-up inspection: Violations required further review but were not an immediate threat to the public. The restaurant complied with a follow-up inspection and met inspection standards on May 30.

Total violations: Seven total violations, with three high-priority violations

Details of high priority violations:

From May 28 inspection:

  • High Priority - Shell eggs not stored at an ambient air temperature of 45 degrees Fahrenheit or less. Raw shell eggs in walk-in cooler at 67 degrees Fahrenheit ambient air for undetermined time. **Warning**
  • High Priority - Stop Sale issued on time/temperature control for safety food due to temperature abuse. In walk-in cooler: Burgers at 65 degrees Fahrenheit, chicken at 64 degrees Fahrenheit. Both undetermined time. Raw shell eggs at 67 degrees Fahrenheit ambient air for undetermined time.
  • High Priority - Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. In walk-in cooler: Burgers at 65 degrees Fahrenheit, chicken at 64 degrees Fahrenheit. Both undetermined time. **Warning**

From May 29 inspection:

  • High Priority - From initial inspection : High Priority - Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. In walk-in cooler: Burgers at 65 degrees Fahrenheit, chicken at 64 degrees Fahrenheit. Both undetermined time. **Warning** - From follow-up inspection 2024-05-29: Burgers and chicken no longer stored in walk-in cooler. Butter at 60 degrees Fahrenheit, and unopened sour cream still stored in walk-in cooler, both stored overnight. Per employee, walk-in cooler ambient temperature read 56 degrees Fahrenheit first thing this morning. **Admin Complaint**

Total violations: Two total violations, with one high-priority violation

Details of high priority violations:

  • High Priority - Vacuum breaker missing at mop sink faucet or on fitting/splitter added to mop sink faucet. Rear mop sink hose attached.

Inspection details: Complaint Partial Inspection on May 30

Follow-up inspection: Violations required further review but were not an immediate threat to the public. The restaurant complied with a follow-up inspection on May 31.

Total violations: Two total violations, with one high-priority violation

Details of high priority violations:

  • High Priority - Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. At salad bar, cut lettuce and shredded cheese both at 46 degrees Fahrenheit. Cut hard boiled eggs at 52 degrees Fahrenheit. All items on salad bar have been out for two hours. Manager set ice under items prior to inspection. **Corrective Action Taken** **Warning**

  • High Priority - Live, small flying insects in kitchen, food preparation area, food storage area and/or bar area. Approximately 10 live flying insects at bar in dining area. **Warning**
  • High Priority - Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. Chicken tenders in reach-in cooler at 53 degrees Fahrenheit for three hours. Manager applied ice bags to cool chicken. **Corrective Action Taken**

What agency inspects restaurants in Florida?

Routine regulation and inspection of restaurants is conducted by the Department of Business and Professional Regulation. The Department of Health is responsible for investigation and control of food-borne illness outbreaks associated with all food establishment.

What does all that terminology in Florida restaurant inspections mean?

Basic violations are those considered against best practices.

A warning is issued after an inspector documents violations that must be corrected by a certain date or within a specified number of days from receipt of the inspection report.

An administrative complaint is a form of legal action taken by the division. Insufficient compliance after a warning, a pattern of repeat violations or existence of serious conditions that warrant immediate action may result in the division initiating an administrative complaint against the establishment. Says the division website: "Correcting the violations is important, but penalties may still result from violations corrected after the warning time was over."

An emergency order − when a restaurant is closed by the inspector − is based on an immediate threat to the public. Here, the Division of Hotels and Restaurants director has determined that the establishment must stop doing business and any division license is suspended to protect health, safety or welfare of the public.

A 24-hour call-back inspection will be performed after an emergency closure or suspension of license.
